Illinois has introduced a new law that places some restrictions on the state’s stringent biometric privacy legislation. On August 2, Governor J.B. Pritzker signed SB2979, a bill that modifies certain aspects of the Illinois Biometric Information Privacy Act. The revisions allow for the use of electronic signatures as a “written release” under the biometrics law. (BIPA was enacted in 2008, before the widespread adoption of electronic signatures.) More significantly, the amendment states that if a private entity collects or shares an individual’s biometric information in violation of the law more than once, it constitutes only one violation. This change effectively…

For carriers, each closure isn’t just a news item—it signifies potential unpaid invoices and diminished cash flow. With profit margins already squeezed by rising costs of equipment, fuel, insurance, and labor, a single default or delayed payment can swiftly disrupt operations. Challenges in an Unstable Market Shipping freight today often involves waiting months for payment, or, in some cases, facing non-payment altogether, which has emerged as a significant risk for carriers. Accounts receivable (A/R) insurance safeguards trucking companies against the threat of clients failing to pay their invoices. What Happens if a Broker Fails to Pay? This type of coverage…
Why do owner-operators and small fleets seek changes in broker transparency regulations? What modifications has the Federal Motor Carrier Safety Administration suggested? The Federal Motor Carrier Safety Administration (FMCSA) has released a long-anticipated proposal focused on broker transparency, which would mandate brokers to maintain electronic records. This proposal stems from requests made over four years ago by the Owner-Operator Independent Drivers Association and the Small Business in Transportation Coalition. The 2020 petitions urged the FMCSA to amend regulations so that brokers would have to disclose, when requested by carriers, details such as the amounts shippers pay brokers for shipments. In…
Trucking companies, drivers, and other road users could significantly benefit from a continuous approach to truck driver health, rather than biannual assessments. The newly established National Registry of Certified Medical Examiners may represent progress in that direction. Trucking companies, drivers, and the general public who share the road with trucks would all benefit from an approach that treats truck driver health as an ongoing project rather than every-other-year paperwork – and the new National Registry of Certified Medical Examiners could be a step in that direction. This message was conveyed by Dr. David McKinney at the recent Fleet Safety Conference…
