INDIANAPOLIS (KABC) — A 69-year-old truck driver, identified as Perry Tole, who was severely injured during an incident involving former USC quarterback Mark Sanchez, is pursuing legal action as he continues to heal.

According to Tole’s attorney, he endured a “violent” and “unprovoked” attack from Sanchez and attempted to defend himself by stabbing the ex-NFL player.
Sanchez, now a commentator for Fox Sports, was initially arrested for several misdemeanors related to the confrontation this past weekend in Indianapolis.
Following revelations about the seriousness of Tole’s injuries, prosecutors upgraded Sanchez’s charges to include a felony for battery resulting in serious bodily harm.
At 38 years old, Sanchez sustained several stab injuries, while Tole endured a deep laceration to his face that passed through his left cheek, as noted in court records.
Tole’s attorney, Erik May, shared that the injury dramatically affects Tole’s speech and causes him significant pain, contributing to his reluctance to speak to the media. Tole’s family is also undergoing emotional distress, with his son set to marry soon, which he will unfortunately miss.
Details of the Incident Involving Mark Sanchez
The altercation occurred early Saturday when Sanchez allegedly approached Tole, who was working at a hotel loading dock, and told him not to park there, according to authorities.
Sanchez reportedly entered Tole’s truck and prevented him from calling for help. Tole claimed that Sanchez shoved him when he attempted to retrieve his phone, leading Tole to use pepper spray in defense.
Fearing for his life as Sanchez approached again, Tole withdrew a knife and stabbed Sanchez multiple times when attacked, according to legal documents.
Tole filed a civil suit against Sanchez and Fox, while Sanchez’s brother expressed gratitude for the outpouring of support during this challenging time. Sanchez remains hospitalized and focused on recovery.
The felony charge Sanchez faces carries a potential sentence of one to six years, according to Marion County Prosecutor Ryan Mears. Sanchez’s next court appearance is scheduled for November 4.
