Arkansas Trucking Association Supports New Cargo Theft Law

Legislative Success for Arkansas Trucking Association

LITTLE ROCK, Ark. – The Arkansas Trucking Association (ATA) has expressed gratitude towards the Arkansas Legislature for enacting a robust set of bills aimed at combating organized retail crime, notably Act 322, which enhances penalties for cargo theft across the state.

Significant Increase in Cargo Theft

“Last year, the industry experienced an alarming 27% rise in cargo theft compared to the previous year, equating to a staggering 1,500% increase since 2001,” stated ATA President Shannon Newton. “These legislative measures showcase the understanding Arkansas lawmakers have regarding the economic dangers posed by organized retail crime and cargo theft, affecting our sector and consumers alike. This success results from the collaboration between policymakers, industry representatives, and officials like Attorney General Griffin.”

Focus on Industry Priorities

The organized retail crime package, championed by Sen. Ben Gilmore (R-Crossett) and Rep. Jeremiah Moore (R-Clarendon), along with support from the Attorney General’s office, addresses a primary concern for the trucking industry: the protection against cargo theft and organized retail crime throughout the supply chain. According to an ATA press release, the legislative package received significant bipartisan backing.

Collaboration for Effective Legislation

“By acknowledging that organized crime infiltrates the entire supply chain—from retail outlets to transportation networks—this collaboration has yielded impactful legislation that will enhance protection for businesses and consumers in Arkansas,” Newton added. “We remain dedicated to partnering with our associates to formulate effective solutions for the challenges ahead.”

Key Features of the Organized Retail Crime Package

The package includes several essential provisions, such as:

  • A structured approach to combat sophisticated retail theft operations (Act 321).
  • Increased penalties of up to an additional 10 years for organized cargo theft (Act 322).
  • Ineligibility for earned release credits on the enhanced sentences for cargo theft (Act 322).
  • Comprehensive coverage of all commercial freight, including rail, trucks, and intermodal containers (Act 322).
  • Criminal penalties for gift card fraud with penalties based on redemption value (SB302).
  • Immediate enforcement due to an emergency declaration.

“This extensive legislation conveys a strong message that organized retail crime and cargo theft will face severe repercussions in Arkansas,” concluded Newton.
