California has retracted its request for the EPA’s approval of its contentious regulations mandating trucking companies to acquire zero-emissions electric and fuel cell trucks.

Withdrawal of the Regulation Request

The California Air Resources Board (CARB) has decided to withdraw its waiver application from the U.S. Environmental Protection Agency (EPA) for its Advanced Clean Fleets (ACF) regulation, citing the unlikelihood of receiving approval from the incoming Trump administration.

CARB Chair Liane Randolph remarked, “This withdrawal is significant considering the uncertainty introduced by the new administration, which has previously criticized California’s initiatives aimed at public health and climate protection.”

Overview of the Advanced Clean Fleets Rule

For the first time, the ACF rule required truck fleets to purchase zero-emission vehicles, diverging from past regulations that primarily targeted manufacturers. The ACF would have necessitated a phased-in schedule for fleet purchasing based on their size and annual revenues, effectively banning the sale of new fossil-fuel trucks by 2036 and requiring large companies to transition their medium- and heavy-duty fleets to zero-emission alternatives by 2042. The State and Local Government Fleets component of these rules remains unchanged for now.

Legal Challenges and Industry Reactions

The Western States Trucking Association criticized CARB, suggesting that blaming the Trump administration is a “diversionary tactic.” They asserted that the original waiver request to the EPA was submitted in November 2023 and raised concerns that the request was withdrawn to avoid a potential rejection.

In addition to regulatory issues, industry groups such as WSTA filed lawsuits against California over the ACF rules, which had been pending at the EPA for over a year. CARB had previously postponed enforcement of these regulations while awaiting the waiver.

Future of Zero-Emission Trucks in California

Despite this withdrawal, California remains committed to advancing zero-emission vehicles. The separate Advanced Clean Trucks (ACT) regulation, which limits sales of truck manufacturers operating in the state, has already secured a waiver from the EPA. However, the American Truck Dealers Association expressed relief at the withdrawal, pointing to unrealistic expectations surrounding the ACF and highlighting the adverse effects on Class 8 truck registrations in California.

Continued Advocacy for Practical Regulations

The Truckload Carriers Association hailed the withdrawal as a significant win, emphasizing their ongoing advocacy for environmentally friendly equipment while stressing the need for practical standards. WSTA welcomed the decision, claiming it reflects the importance of heavy-duty vehicles, particularly in light of recent power outages affecting charging infrastructure.
