Independent Contractor’s Journey Amid Legislative Challenges
For over three decades, I’ve built my career as an independent contractor in the trucking industry. Being my own boss allowed me to raise my four daughters and support my family while shaping my business journey. However, in 2020, my livelihood faced turmoil due to a law from Sacramento lawmakers that overlooked the realities of how truckers operate, putting thousands of us at risk.
The Impact of Assembly Bill 5
Assembly Bill 5 (AB 5) enforced a uniform employment definition, making it nearly impossible for small truckers to work independently in California. This presented me with an agonizing choice: remain in my home state and watch my business deteriorate or leave California to safeguard the freedom I had fought to maintain.
A Tough Decision to Leave
Ultimately, I chose to relocate.
Fighting for Independent Truckers
Independent truckers across the nation watched the developments in California with apprehension. Many of us are women, veterans, immigrants, and first-generation business owners. The ability to dictate our working conditions is not just a benefit; it is crucial for our survival.
Support from Legislators
I’m thankful to Rep. Kevin Kiley for advocating for independent workers like me by introducing the “Modern Worker Empowerment Act.” This legislation, which passed out of committee in the House of Representatives in late July, marks a substantial achievement for independent contractors.
A Step Toward Fairness
The bill reinstates a sensible definition of independent work, allowing truckers like myself to continue our businesses without the constraints of outdated employment models. After the detrimental effects of AB 5 in California, it’s promising to see Congress taking positive steps forward.
Restoring Dignity and Opportunity
Rep. Kiley recognizes that defending independent contractors is about more than just economics; it encompasses dignity, autonomy, and fairness. He witnessed the adverse effects of AB 5 in California and acted to prevent similar errors from affecting workers nationwide.
Hope for the Future
Driving my truck as a small business allowed me the flexibility to take long hauls across the country, even bringing my kids along while ensuring our family’s well-being. I take pride in being a role model, demonstrating that women can thrive behind the wheel, own businesses, and contribute significantly to America’s supply chain.
Looking Ahead
Thanks to advocates like Rep. Kiley, Washington is finally acknowledging that independent contractors deserve the same respect and freedoms as traditional employees. I hope the Senate swiftly passes this bill and sends it to the president. While I had to leave California to sustain my business, this new legislation gives me hope that I could return one day.
