Acquittal of Trucking Company Owner in Freedom Convoy Case
OTTAWA, ON: The Justice Centre for Constitutional Freedoms is pleased to report that Harold Jonker, a trucking company owner, has been acquitted of all charges stemming from his peaceful participation in the 2022 Freedom Convoy protest in Ottawa. Justice Kevin B. Phillips from the Ontario Superior Court of Justice announced the verdict today.
Background of Mr. Jonker
Mr. Jonker, a trucker based in West Lincoln, Ontario, served as a “road captain” for the Niagara contingent of the Freedom Convoy and arrived in Ottawa on January 28, 2022. He stayed in the city for three weeks.
Protest Participation
During his time in Ottawa, he parked his vehicle on Coventry Road, outside the downtown area, and did not receive any fines or charges while present in the city.
Charges Filed
In May 2023, fifteen months post-protest, the police charged Mr. Jonker with mischief, counselling mischief, intimidation, and counselling intimidation. The allegations included claims that he helped organize parts of the Convoy and that trucks from his company, Jonker Trucking Inc., were seen in downtown Ottawa during the protest.
Trial Proceedings
The trial occurred from May 12 to 14, 2025, in the Ontario Superior Court of Justice in Ottawa, where the Crown called four witnesses, including two police officers and two civilians.
Judgment and Findings
In his oral judgment on May 20, 2025, Justice Phillips addressed key arguments presented by the Crown. He determined that Mr. Jonker’s interviews during and after the protest were treated as observations rather than incitements to unlawful actions. Additionally, the court found inadequate evidence indicating that Mr. Jonker had control over the trucks in question.
Response to Acquittal
Constitutional lawyer Chris Fleury expressed satisfaction with the verdict, stating that the Crown failed to meet the burden of proof. Following the acquittal, Mr. Jonker expressed his thankfulness for the strong legal support he received and appreciated the judge’s scrutiny of the Crown’s case.
