South Florida Trucking Company Owner Arrested for Insurance Fraud
A trucking company owner in South Florida was apprehended last month for allegedly selling fake insurance policies that totaled nearly $60,000 to local truckers, as reported by Florida Chief Financial Officer (CFO) Jimmy Patronis.
Details of the Allegations
According to the Department of Financial Services (DFS), Kemny Niebla, the owner of Andoba Trucking Co. and Sea Trucking based in Hialeah, collected monthly insurance premium payments from three victims between October 2017 and June 2018.
Financial Misconduct
Investigation records revealed that Niebla received a total of $59,675 in premiums that he failed to apply to any legitimate insurance policy as promised. Instead, DFS claims he pocketed the funds, leaving the commercial vehicles to operate without insurance.
Discovery of the Fraud
The fraudulent activities came to light after one of the commercial trucks was involved in an accident incurring over $78,000 in damages that were not covered by insurance.
Arrest and Charges
Niebla was arrested without incident on November 30, 2018, and taken to the Turner Guilford Knight Correctional Center. He faces multiple charges, including grand theft, diversion of insurance funds, issuance of forged instruments, and orchestrating a scheme to defraud.
Potential Consequences
If convicted on all charges, Niebla could face a maximum sentence of 20 years in prison.
Official Remarks
“Taking insurance premiums for personal profit is disgraceful. It leaves victims without adequate insurance coverage and endangers unsuspecting drivers financially,” CFO Patronis commented.
