New Trucking Alliance Targets Independent Contractor Regulations

New Trucking Trade Group Formed

A newly established trade organization focused on trucking has emerged in Washington, primarily concentrating on one key issue: the status of independent contractors.

Introducing TIE

The group, named Truckers Integral to our Economy (TIE), is led by executive director Scott Brenner, who also serves at Crossroads Strategies, a lobbying firm based in the Washington area. Brenner shared with FreightWaves that he has approximately a decade of experience in Congress, particularly with the Ways and Means and Transportation committees, along with a tenure at the Department of Transportation.

Focus on Federal Regulations

While debates around independent contractor status have predominantly taken place at the state level, with California’s AB5 being a central point of contention, Brenner emphasized that TIE will not delve into state matters. Instead, TIE is specifically concerned with the Department of Labor’s proposed definition of independent contractor status set to guide the Wage and Hour Division in resolving employer-employee disputes.

Current Regulatory Landscape

The existing rule under the Wage and Hour Division was introduced during the last days of the Trump administration and is believed to favor the classification of workers as independent contractors. This rule represents a stance that many in the trucking industry see as beneficial for independent owner-operators.

Concerns for Owner-Operators

In the trucking industry, there is a consensus that the proposed law poses risks for independent owner-operators. While it doesn’t incorporate the ABC test’s stringent criteria, certain provisions may inadvertently present challenges for these operators if interpreted unfavorably during actions before the Wage and Hour Division.

A Call to Action

As TIE continues to navigate these complex issues, the group’s advocacy will be crucial in shaping the future of independent contracting in the trucking sector. The outcome of the Department of Labor’s proposed regulations could significantly impact many stakeholders in the industry.
